Living Trust Information

Using a Revocable Living Trust is the most common estate planning device to avoid probate and safeguard one's estate for their beneficiaries.

You receive all Revocable Living Trust documents (for your signature and notarization), Deeds for any transfer of real property into the name of the Trust, Tax documents for filing with the county, Letters for non-real estate property transfers, and a Pour-over Will to enable any after-aquired property to "pour over" into the Trust and be distributed according to the terms of the trust after the Trust document is signed.

If you need to update your Revocable Living Trust at a later date, we have made it easy to do so. Simply fill out the one question on the next page that asks for modifications and tell us what they are. There is a small processing fee of $35 for this service. To best assist you, please have the following information nearby when submiting your information:
1) Names, addresses, phone numbers, and date of birth of all children;
2) Name and address of sucessor trustee and alternate successor trustee;
3) Names, account numbers, and phone numbers of any assets you desire to place in the Trust (e.g., mutual funds, IRAs, savings accounts, etc.)(NOTE: Insurance benefits, 401K, and pension funds are best not put in Trust)(ALSO: We will assume these assets are marital community property. Please tell us if they are owned by one partner in the marriage);
4) Legal description (preferred) OR name of seller and date of sale of any real property you wish to place in trust. Also include tax assessors parcel number.
